Notice and Takedown Procedure

Agastya Srivastava dba LabelsDigital.com respects intellectual property rights and expects the same from others. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), we provide the following procedure for submitting DMCA notices.

DMCA Takedown Notice Requirements

To submit a notice of claimed copyright infringement, please provide our designated agent with the following information:

  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the infringing material and its location on LabelsDigital.com (specific URL)
  4. Your contact information, including:

    • Email address
    • Phone number
  5. A statement of good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

Counter-Notice Procedure

If you believe your content was wrongly removed due to a DMCA notice, you may submit a counter-notice containing:

  1. Your physical or electronic signature
  2. Identification of the removed material and its previous location
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  4. Your contact information and consent to federal district court jurisdiction where you are located
  5. Your consent to accept service of process from the party who submitted the takedown notice

Repeat Infringer Policy

LabelsDigital.com maintains a strict policy against repeat copyright infringers. Users who repeatedly infringe copyrights will have their accounts terminated in appropriate circumstances.

Email is the preferred method for submitting DMCA notices, as it ensures the fastest response time. By submitting a DMCA notice, you acknowledge that a copy of your submission may be shared with the accused party.

Note: Under 17 USC §512(f), any person who knowingly misrepresents material or activity as infringing may be subject to liability for damages, including costs and attorneys’ fees.
